Funeral & Death Benefits

Funeral and death benefits are payable as follows:

Funeral Benefits

Where the death of a person results directly from a motor accident, burial or cremation expenses reasonably incurred may be payable as funeral benefits (other than expenses incurred in the provision or erection of any gravestone) subject to the prescribed maximum amount.

The maximum amount from 21 May 2010 is $8,813.

Death Benefits

Where the death of a person results directly from a motor accident and the person is survived by one or more dependants, a lump sum is payable as death benefits.

For motor accidents that have occurred on or after 1 December 2007, the lump sum payable is $62,000. If the deceased is survived by two or more dependants of whom at least one is a dependent child, the lump sum is to be increased by an amount ranging from $3,000 to $15,000 per child depending on the age of the child.

For motor accidents that have occurred on or after 1 March 2010, the lump sum payable is $70,000. If the deceased is survived by two or more dependants of whom at least one is a dependant child, the lump sum is to be increased by an amount ranging from $3,750 to $18,750 per child depending on the age of the child.

The tests for eligibility and full details of benefits payable are set out in the Regulations to the Act.
